Welcome to WiiShoppe.

WiiShoppe provides an online marketplace where businesses and independent sellers can list, promote and sell products to customers.

This Seller Policy establishes the standards and responsibilities that apply to sellers using the WiiShoppe marketplace.

By registering for a seller account, listing a product or accepting an order through WiiShoppe, you agree to comply with this Seller Policy, the WiiShoppe Terms & Conditions and other applicable marketplace policies.

1. Seller Eligibility

Sellers must provide accurate and complete information when registering with WiiShoppe.

Depending on the type of seller or products offered, WiiShoppe may request information including:

  • Full name;

  • Business or trading name;

  • Email address;

  • Telephone number;

  • Business address;

  • Identification;

  • Business registration information;

  • Banking or payout information; and

  • Other information reasonably required for verification.

WiiShoppe reserves the right to verify seller information before or after activating a seller account.

2. Seller Verification

WiiShoppe may conduct reasonable verification procedures to protect customers and the marketplace.

Sellers may be required to provide documentation confirming their identity, business information, contact details or authority to sell certain products.

Providing false, altered, misleading or fraudulent information may result in rejection, restriction or suspension of the seller account.

3. Seller Responsibilities

Sellers are responsible for:

  • Maintaining accurate account information;

  • Providing accurate product listings;

  • Maintaining appropriate stock levels;

  • Setting accurate prices;

  • Supplying genuine and lawful products;

  • Processing accepted orders promptly;

  • Packaging products appropriately;

  • Meeting applicable delivery or collection obligations;

  • Responding to legitimate customer enquiries;

  • Handling returns and warranty matters appropriately;

  • Complying with WiiShoppe marketplace policies; and

  • Complying with applicable laws and regulations.

4. Product Listings

Product listings must accurately represent the item being sold.

Listings should include appropriate information such as:

  • Product name;

  • Product description;

  • Price;

  • Product condition;

  • Relevant specifications;

  • Size or dimensions where applicable;

  • Colour or variation where applicable;

  • Product photographs;

  • Stock availability; and

  • Relevant warranty information.

Sellers must not deliberately conceal defects or materially misrepresent products.

5. Product Images

Product photographs should accurately represent the product being offered.

Sellers must have the right or permission to use images uploaded to WiiShoppe.

Images must not intentionally mislead customers about the product's:

  • Condition;

  • Quantity;

  • Size;

  • Colour;

  • Features;

  • Brand; or

  • Included accessories.

WiiShoppe may remove inappropriate, misleading or unauthorized images.

6. Product Pricing

Sellers are responsible for ensuring that prices displayed on their listings are accurate.

Prices should clearly reflect the amount customers are expected to pay for the product, subject to separately disclosed delivery, tax or other applicable charges.

Sellers must not intentionally advertise misleading prices to attract customers and then demand a materially different price outside the platform.

7. Inventory and Availability

Sellers are responsible for maintaining reasonably accurate inventory information.

Products that are unavailable should be marked as unavailable or removed from sale as soon as reasonably possible.

Repeated cancellation of customer orders because of inaccurate inventory may result in seller-account review or restrictions.

8. Order Fulfilment

Sellers must make reasonable efforts to fulfil accepted orders accurately and within the applicable processing period.

Sellers are responsible for supplying:

  • The correct product;

  • The correct quantity;

  • The correct variation;

  • Products in the advertised condition; and

  • Any accessories or components stated in the listing.

Sellers should promptly notify WiiShoppe where an accepted order cannot be fulfilled.

9. Order Cancellation

Sellers should not cancel accepted orders without a legitimate reason.

Legitimate circumstances may include:

  • Unexpected stock shortages;

  • Product damage discovered before fulfilment;

  • Pricing or listing errors;

  • Suspected fraudulent transactions;

  • Delivery limitations; or

  • Other circumstances preventing lawful or reasonable fulfilment.

Repeated or excessive seller cancellations may result in account review.

10. Delivery and Collection

Where sellers are responsible for delivery or collection arrangements, they must provide accurate information and make reasonable efforts to meet the agreed arrangements.

Products should be appropriately packaged to reduce the risk of damage during transportation.

Where WiiShoppe or an approved delivery provider manages delivery, sellers must comply with applicable fulfilment and handover requirements.

11. Returns, Refunds and Exchanges

Sellers must comply with the WiiShoppe Return, Refund & Exchange Policy and applicable consumer protection requirements.

Sellers must not use blanket statements intended to unlawfully deny customers legitimate consumer remedies.

Where a product is defective, damaged, materially misrepresented, incorrect or otherwise qualifies for a remedy, the seller must cooperate with WiiShoppe and the customer to resolve the matter appropriately.

Depending on the circumstances, remedies may include:

  • Repair;

  • Replacement;

  • Exchange;

  • Store credit; or

  • Refund.

12. Product Quality and Condition

Products must be supplied in the condition represented in the listing.

Where an item is:

  • Used;

  • Refurbished;

  • Open-box;

  • Damaged;

  • Display stock; or

  • Otherwise not new,

this must be clearly disclosed before purchase.

Known material defects should also be disclosed.

13. Counterfeit Products

Counterfeit products are prohibited on WiiShoppe.

Sellers must not list products that:

  • Falsely use another company's trademark;

  • Imitate branded products while being represented as genuine;

  • Use counterfeit packaging;

  • Infringe intellectual property rights; or

  • Are otherwise unlawfully reproduced.

WiiShoppe may request evidence of authenticity where reasonably necessary.

Suspected counterfeit listings may be removed while the matter is investigated.

14. Prohibited and Restricted Products

Sellers must not use WiiShoppe to offer products whose sale is unlawful or prohibited by WiiShoppe.

Prohibited or restricted items may include, depending on applicable law and marketplace rules:

  • Stolen goods;

  • Counterfeit products;

  • Illegal drugs;

  • Unlawfully sold prescription medication;

  • Illegal weapons or explosives;

  • Fraudulent documents;

  • Hazardous or unsafe products;

  • Products that infringe intellectual property rights;

  • Illegally obtained goods; and

  • Other products whose sale is prohibited by applicable law.

WiiShoppe may maintain additional prohibited or restricted-product rules.

15. Product Safety

Sellers are responsible for ensuring that products offered through WiiShoppe comply with applicable safety requirements.

Sellers must not knowingly sell products that have been recalled, declared unsafe or pose an undisclosed material safety risk.

Where a seller becomes aware of a significant safety issue affecting a listed or previously sold product, the seller should notify WiiShoppe promptly.

16. Customer Service

Sellers are expected to communicate with customers professionally and respectfully.

Sellers should respond within a reasonable period to legitimate enquiries concerning:

  • Orders;

  • Products;

  • Delivery;

  • Returns;

  • Warranty matters; and

  • Complaints.

Abusive, threatening, discriminatory or fraudulent communication is prohibited.

17. Buyer and Seller Disputes

Sellers are expected to cooperate with WiiShoppe when investigating customer disputes.

WiiShoppe may review relevant information including:

  • Product listings;

  • Order records;

  • Customer and seller communications;

  • Photographs;

  • Video;

  • Delivery information;

  • Payment records; and

  • Other relevant evidence.

Sellers must not provide false or deliberately misleading evidence during a dispute.

18. Seller Ratings and Reviews

Customers may be permitted to rate products and sellers.

Sellers must not:

  • Purchase fake reviews;

  • Create fake customer accounts;

  • Offer improper incentives for misleading reviews;

  • Threaten customers over negative reviews; or

  • Manipulate WiiShoppe's review system.

Sellers may respond professionally to customer feedback where that feature is available.

19. Seller Fees and Commissions

WiiShoppe may charge sellers fees for accessing or using marketplace services.

These may include:

  • Sales commissions;

  • Listing fees;

  • Subscription fees;

  • Promotional or advertising fees;

  • Transaction fees;

  • Delivery-related charges; or

  • Other marketplace service fees.

Applicable fees will be communicated through the seller account, seller agreement, fee schedule or other applicable documentation.

Sellers are responsible for reviewing applicable fees before using paid marketplace services.

20. Seller Payouts

Where WiiShoppe collects payments on behalf of sellers, eligible seller funds will be processed according to the applicable payout arrangements.

Payouts may be affected by:

  • Transaction processing periods;

  • Returns;

  • Refunds;

  • Chargebacks;

  • Customer disputes;

  • Fraud investigations;

  • Payment-provider requirements;

  • Account verification; or

  • Other legitimate transaction adjustments.

WiiShoppe may require sellers to provide accurate payout information before funds can be transferred.

21. Refunds and Seller Balances

Where a seller is responsible for a customer refund, the applicable amount may be deducted from:

  • Pending seller funds;

  • Future seller payouts;

  • Seller account balances; or

  • Another applicable settlement method.

The seller may be required to reimburse WiiShoppe where WiiShoppe has issued a customer refund for which the seller is responsible.

22. Chargebacks and Payment Disputes

Where a customer disputes a payment through a bank, card issuer or payment provider, WiiShoppe may request information from the seller to assist with the investigation.

Sellers must provide requested transaction evidence within a reasonable period.

Where a chargeback is validly assessed against a transaction attributable to the seller, the relevant amount and applicable charges may be deducted from seller funds where permitted.

23. Holding Seller Funds

Where reasonably necessary and permitted by applicable law and payment arrangements, WiiShoppe may temporarily delay or hold funds associated with:

  • An active customer dispute;

  • Suspected fraud;

  • Suspected counterfeit goods;

  • A chargeback;

  • An incomplete transaction;

  • A serious marketplace-policy violation; or

  • A security investigation.

Funds should not be withheld longer than reasonably necessary to address the relevant matter, subject to payment-provider and legal requirements.

24. Transactions Outside WiiShoppe

Sellers must not use WiiShoppe primarily to identify customers and then intentionally redirect transactions outside the platform for the purpose of avoiding applicable WiiShoppe fees, protections or marketplace procedures.

Examples may include requesting that a customer cancel a WiiShoppe order and pay the seller privately solely to avoid marketplace fees.

Such conduct may result in seller-account restrictions.

25. Customer Information and Privacy

Sellers may receive customer information where necessary to fulfil orders.

Customer information must only be used for legitimate transaction and marketplace purposes.

Sellers must not:

  • Sell customer information;

  • Use customer information for unauthorized purposes;

  • Send unauthorized marketing communications;

  • Publicly disclose customer information; or

  • Retain or distribute information unnecessarily.

Sellers must comply with applicable privacy requirements and the WiiShoppe Privacy Policy.

26. Intellectual Property

Sellers must have the appropriate rights to use:

  • Product photographs;

  • Brand names;

  • Logos;

  • Descriptions;

  • Videos;

  • Designs; and

  • Other copyrighted or trademarked material included in their listings.

WiiShoppe may remove listings that reasonably appear to infringe third-party intellectual property rights.

27. Fraudulent Activity

Fraudulent activity is prohibited.

Examples include:

  • Fake orders;

  • False tracking information;

  • Selling products the seller does not intend to supply;

  • Manipulating transactions;

  • False refund claims;

  • Using stolen information;

  • Creating multiple accounts to circumvent restrictions; and

  • Deliberately misleading customers or WiiShoppe.

Serious suspected fraud may result in immediate account restrictions while an investigation is conducted.

28. Seller Account Performance

WiiShoppe may monitor seller performance to maintain marketplace quality.

Factors may include:

  • Order fulfilment;

  • Cancellation frequency;

  • Customer complaints;

  • Delivery performance;

  • Product accuracy;

  • Return rates;

  • Policy violations; and

  • Fraud or security concerns.

Performance information may be used to identify sellers requiring additional support or marketplace restrictions.

29. Account Suspension or Termination

WiiShoppe may restrict, suspend or terminate seller privileges where reasonably necessary because of:

  • Serious or repeated policy violations;

  • Fraudulent activity;

  • Sale of prohibited products;

  • Counterfeit goods;

  • Repeated failure to fulfil orders;

  • Significant customer-safety concerns;

  • Abuse of customers or WiiShoppe staff;

  • Manipulation of marketplace systems; or

  • Other serious violations of applicable requirements.

Depending on the circumstances, WiiShoppe may provide the seller with information regarding the reason for the action and available review procedures.

30. Seller Account Closure

Sellers may request closure of their seller account.

Outstanding matters may need to be resolved before final closure, including:

  • Pending orders;

  • Returns;

  • Refunds;

  • Customer disputes;

  • Chargebacks;

  • Outstanding seller balances; and

  • Other unresolved marketplace obligations.

Account closure does not automatically eliminate obligations arising from transactions completed before closure.

31. Taxes and Legal Responsibilities

Sellers are responsible for understanding and complying with tax, registration, licensing and other legal requirements applicable to their own business and products.

WiiShoppe does not provide individual tax or legal advice to sellers.

32. Cooperation With WiiShoppe

Sellers must reasonably cooperate with WiiShoppe when information is required regarding:

  • Customer complaints;

  • Product safety;

  • Fraud;

  • Returns;

  • Chargebacks;

  • Delivery disputes;

  • Intellectual property complaints; or

  • Marketplace investigations.

Failure to cooperate may affect the seller's ability to continue using WiiShoppe.

33. Changes to This Seller Policy

WiiShoppe may update this Seller Policy from time to time to reflect changes to:

  • Marketplace operations;

  • Seller services;

  • Fees;

  • Payment processes;

  • Security requirements;

  • Business practices; or

  • Applicable legal requirements.

The latest version will be published on WiiShoppe with an updated Last Updated date.

Material changes affecting sellers will be communicated where reasonably appropriate.

34. Relationship With Other WiiShoppe Policies

Sellers must also comply with applicable WiiShoppe policies, including the:

  • Terms & Conditions;

  • Privacy Policy;

  • Return, Refund & Exchange Policy;

  • Support Policy;

  • Shipping and Delivery Policy; and

  • Any applicable fee, payment or promotional terms.

If a seller operates additional policies, those policies must not conflict with mandatory legal requirements or applicable WiiShoppe marketplace rules.

35. Governing Law

This Seller Policy is governed by the laws of the Republic of Trinidad and Tobago.

Nothing in this policy is intended to exclude or restrict rights or obligations that cannot lawfully be excluded.

When contacting WiiShoppe regarding a particular order, please provide the relevant order number whenever possible.
